GENERAL RESOLUTION FOR THE NEW AMOUNT FOR FOREIGN INVESTMENT IN MEXICAN COMPANIES

The General Resolution was published in the Official Gazette of the Federation, which modifies the amount referred to in the foreign direct or indirect investment for which a favorable resolution from the National Foreign Investment Commission is required for such investment to participate in the social capital of Mexican companies in a proportion greater than 49% of said capital, only when the total value of assets at the time of submitting the acquisition request exceeds the amount determined annually by the Commission.

 

In this regard, Article 9 of the Foreign Investment Law establishes the final annual amount set for the year 2024 by the sum of $26,978,252,017.64 (Twenty-six Billion Nine Hundred Seventy-eight Million Two Hundred Fifty-two Thousand Seventeen Pesos 64/100 M.N.).

 

According to Article 3 of the Regulation of the Foreign Investment Law and National Registry of Foreign Investments, this participation regime applies when the acquisition of shares or social parts occurs in already established companies and in Companies whose activities are not subject to specific regulation or do not carry out reserved activities.

 It is worth mentioning that this resolution comes into effect on June 25, 2024.
