Use of the trademark HECHO EN MÉXICO / MADE IN MÉXICO

 

Did you know that MADE IN MEXICO is a registered trademark owned by the Ministry of Economy, and that it is required a special permit to use it? 

The distinctive sign "Made in Mexico" is highly popular among the general population. However, what remains unknown to most are its scopes and the implications of its use.

This sign was created in 1978 by the Government of Mexico through the Ministry of Economy with the intention of promoting the consumption of national products, making them easily identifiable to everyone by adding the distinctive sign.

Since its creation, the trademark has had various design changes, as well as changes in the requirements to obtain authorization for its use. However, its function has always been to highlight products made in Mexico, emphasizing their quality as well as the talent, creativity, and innovation of Mexicans. 

The current rules for the use of this trademark are stipulated in the Agreement establishing the conditions and requirements for granting authorization and using the emblem "Made in Mexico", published in the Official Gazette of the Federation on November 22, 2018.

The "Made in Mexico" sign may only be marked, printed, and reproduced on the packaging of those products expressly authorized.

To obtain authorization for the use of the MADE IN MEXICO emblem, it is necessary to have a Certificate of Conformity issued by an accredited and authorized Certification Organism that certifies compliance with the established requirements.

Currently, in Mexico, there are 8 licensees of the Ministry of Economy empowered to grant authorization for the use of the MADE IN MEXICO mark.

Those interested in obtaining authorization for the use of the MADE IN MEXICO trademark must demonstrate that the products are produced and manufactured in the Mexican Republic under different specifications depending on the type of products involved.

Authorization for the use of the emblem is granted to interested parties who demonstrate to the Certification Organism, previously accredited by the Mexican Accreditation Entity and authorized by the General Directorate of Standards of the Ministry of Economy, that their products meet the established requirements. 

The use of the design must comply with the rules established in the MADE IN MEXICO Graphic Identity Manual, which specifically outlines guidelines for its use on the corresponding products. 

Authorizations and sublicenses for the use of the emblem are valid for two years and can be renewed for the same period. Requests for renewal must be made to the corresponding Authority at least two months before the expiration date.

Obtaining a certificate of conformity for the use of the mark has several benefits for the products granted, both nationally and internationally, such as preference for national products or even facilitation of entry into international trade.

It is important to remember that unauthorized use of this mark may have severe legal consequences. Therefore, the emblem should never be used without meeting the corresponding conditions.
